What does the Telecommuting Law consist of?
The objective of this law is to provide the necessary regulation for companies to implement the telecommuting modality, and that both companies and teleworkers benefit from it. - Right to a flexible schedule. If the agreement so provides, the teleworker may modify his working hours, respecting the time of work and rest.
- Right to adequate time registration. The recording system used must accurately reflect the working time and include the start and end time of the working day, among other data.
- Right to occupational risk prevention. The company must carry out a risk assessment and planning of the preventive activity of remote work.
- Right to privacy and data protection. The company will not be able to demand the installation of programs or applications in devices that are property of the teleworker, neither the use of these for the development of the remote work. The use of telematic means and digital devices will have to guarantee the respect to this right.
- Right to digital disconnection. They will have the right to disconnection outside their working hours.
- Collective rights. They may exercise their rights of a collective nature to the same extent as those of employees working in person.
